The right to access one’s personal data and other rights
1. The person concerned has the right to know of the existence of personal data that concerns him/her even if the data has not yet been recorded. The data must be communicated in an intelligible manner.
2. The person concerned has the right to obtain information on:
a. the origins of the personal data;
b. the purpose and methods of data processing;
c. the logic applied to any data processing that has been carried out with the aid of electronic tools;
d. details of the owner, the manager and the designated representative pursuant to article 5, paragraph 2;
e. the persons or category of persons to whom the personal data may be communicated to or the persons or category of persons who may come in contact with the data as a designated representatives of managers or agents in the territory of Italy.
3. The person concerned has the right to obtain:
a. updates, corrections or if it is in his/her interests, the changes to the data;
b. the cancellation, the change to an anonymous form, the blocking of data which has been unlawfully processed including the case where the purpose for which the data was collected and then processed does not require said data to be stored;
c. confirmation that the persons to whom the data was communicated to or disclosed were informed of the operations as of letters a) and b) – even in terms of their contents; unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. The person concerned has the right to object, in whole or in part:
a. on legitimate grounds, to the handling of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b. to the processing of personal data concerning him/her, when it is carried out for the purpose of sending advertising materials, direct selling, market research purposes or commercial communications.
